General terms and conditions swimming lessons

Where these terms and conditions refer to: 

• The Geusseltbad: this refers to the swimming facilities and associated amenities, located at Discusworp 4, 6225 XP Maastricht.
• The participant: this refers to the individual who actually takes part in the swimming lessons.
• The customer: this refers to the person who legally represents the swimming lesson participant in contractual matters.

• Pre-certificate swimming lessons

1. Participation in swimming lessons is possible from the age of 4.
2. Participation in swimming lessons for the B and C diplomas is only permitted if the swimming lesson participant holds the A and/or B diploma.
3. Swimmers without any prior swimming experience will always be placed in the program leading to the A diploma.
4. Swimming lesson participants with prior experience are advised to have their starting level assessed by a swimming instructor at the Geusseltbad before registering. The cost of a trial lesson will be charged for this assessment. The customer can schedule an appointment for this with the Geusseltbad. The level assessment by the swimming instructor is binding.

• It is not possible to purchase individual lessons.
• Depending on the diploma for which one is swimming, different payment options apply: 
  a. Payment in advance by means of 4-week cards 
  b. Payment in advance by means of a lump sum for the A diploma, with the option to pay in instalments (All-in package) 
  c. Payment for swimming lessons for the B or C diploma by means of a lump sum (All-in package)

Customers who are entitled to a contribution from the Jeugdfonds Sport or the Stichting Leergeld may use this contribution for 4-week cards or a lump-sum payment arrangement. From the moment the contribution has been fully used, the customer is responsible for covering the remaining costs. The contribution from these funds is generally not sufficient to cover the full cost of an All-in A Diploma package.

Geusseltbad provides swimming lessons in accordance with the conditions and requirements of the National Council for Swimming Safety (NRZ). Only certified instructors are employed. The NRZ conducts random inspections to verify that diplomas are awarded appropriately. This ensures a high standard of quality in the swimming lessons.

With an All-in package, you pay a fixed amount for obtaining your swimming diploma. This includes:

• All swimming lessons up to the moment the diploma(s) is obtained
• Any additional lessons if required
• Pre-certificate swimming
• Diploma swimming

• Registration fee including card (to be paid upon registration)
• Swimsuit
  For A diploma lessons, the use of the EasySwim suit is mandatory. This suit can be purchased at the Information Desk. The suit remains the property of the customer.

We offer the following all-in packages:

• All-in package for diploma A

If the customer purchases an all-in package for diploma A, B, or C, the swimming lesson pass remains valid through the final lesson, the pre-certificate swimming, and the diploma swimming.

Customers who purchase the All-in package are not required to pay for swimming lessons until the diploma has been obtained. A diploma guarantee applies. However, customers must meet several conditions:

1. The swimming lesson participant must begin lessons at the entry level determined by Geusseltbad.
2. The swimming lesson participant must not have any physical or cognitive limitations that would result in an unreasonable increase in the number of lessons typically required to obtain the diploma.
3. The swimming lesson participant may miss a maximum of 6 lessons prior to the first scheduled diploma exam for the group in which they are placed. This corresponds to approximately 10% of the total number of lessons generally needed to earn the diploma. If more lessons are missed, the missed sessions must be made up at the customer’s own expense. If this does not occur, the All-in package A will expire after the average duration required to obtain the diploma (45 clock hours), or in the case of All-in package B or C, after 10 clock hours. If the swimmer has not reached the required level to participate in the diploma exam at that point, they must purchase 4-week lesson cards.

In the case of an All-in package for diploma A, B, or C, early termination is permitted. Termination must be submitted in writing. A notice period of four weeks applies. The remaining credit after this notice period has elapsed will be refunded to the customer. This also applies, for example, in the case of relocation.

With a 4-week card, swimming lessons are paid for in 4-week periods.

The 4-week card is valid for four weeks from the date of purchase or from the expiry date of the previous card. This means it covers 4 swimming lessons for once-a-week participation, or 8 lessons for twice-a-week participation.

If the validity of the card has expired, it must be renewed immediately in order to continue swimming lessons. If this is not done, the right to participate in swimming lessons will lapse, and the available spot may be assigned to someone else.

• Lessons can only be attended on the agreed-upon days.
• Participation in lessons must take place on a weekly and consecutive basis.
• If a participant does not attend a swimming lesson during a given period (for example, due to vacation, family event, etc.), the credit for that lesson will expire, and the cost of the missed lesson will be deducted from the 4-week card.
• If a participant does not attend a lesson and has not yet purchased a new 4-week card, the credit for the missed lesson will be immediately deducted upon purchase of the new 4-week card.
• Customers whose participation in diploma swimming has been confirmed and who have received an invitation for the pre-certificate swimming test are not required to purchase a new 4-week card. They may purchase individual lesson tickets for the remaining swimming lessons.

Switching from a 4-week card to an All-in package for diploma A, B, or C is possible. However, no refund or credit will be issued for previously purchased 4-week cards.

• Early termination is not possible in the case of 4-week cards.
• Customers who have purchased a 4-week card and continue with a subsequent diploma at Geusseltbad after obtaining their current diploma may use the remaining swimming lessons on the existing card. Customers who discontinue swimming lessons are entitled to a refund of the remaining credit on the 4-week card.

1. Customers who register can choose from a number of different swimming time slots. These time slots can be found online. Customers may choose to swim once or twice per week.
2. For private lessons, multiple scheduling options are available.
3. Each year, there are certain periods during which Geusseltbad does not offer swimming lessons. The exact dates can be found at www.geusseltbad.nl/en/opening-hours. These include, among others, all public holidays, the Christmas break, Carnival, and the summer holiday.
4. If Geusseltbad cancels swimming lessons during these periods, the validity of the swimming lesson pass will automatically be extended for the corresponding duration.

• To participate in swimming lessons, customers must register. To do so, the customer must complete the swimming lesson registration form in full. By signing the registration form, the customer agrees to the terms and conditions and enters into a payment obligation.
• The customer is required to pay the registration fee upon registration.
• The customer is also required to pay the lesson fees before the swimming lessons begin.
• Customers who have registered will receive a proof of registration.

The customer is required to provide various personal data. The requested information is necessary for administrative purposes, to ensure a safe environment for the swimmer, to place the swimmer at the appropriate level, to advise you properly on the most suitable product, and to make optimal use of the student tracking system. The data provided will be managed and used by Geusseltbad in accordance with the Personal Data Protection Act.

Customers who wish to participate in swimming lessons at Geusseltbad must first register on the waiting list before being assigned to a lesson group. Swimmers placed on a waiting list will be invited to join lessons in the order of registration. If a customer is unable to accept the invitation, they will be placed back on the waiting list.

Changing the frequency of swimming lessons and/or lesson days is possible. However, there must be availability in the other swimming groups. Customers must submit a written request to Geusseltbad.

Geusseltbad determines: 

1. The level at which the swimming lesson participant enters the lesson program.
2. Whether and when the swimming lesson participant may participate in the diploma exam. A pre-certificate swimming session is held for this purpose. Participation in this session is mandatory. The dates for pre-certificate swimming and diploma swimming can be found online. Swimming lesson participants who are unable to attend the pre-certificate swimming session are not eligible to participate in the diploma swimming.
3. In which pool the swimming lessons, pre-certificate swimming, and diploma swimming take place. This may vary during the course of the lesson program.
4. Which instructor is assigned to the group, with the aim of keeping the same instructor with the group for as long as possible until the diploma is achieved.

All children who are participating in swimming lessons at Geusseltbad or are on the waiting list may take part in recreational swimming free of charge on Wednesday afternoons, during weekends, and throughout the Maastricht school holidays. Accompanying adults are required to pay the applicable admission fee.

Transferring 4-week cards and all-in packages for diploma A, B, or C to third parties is not permitted.

If swimming lessons are cancelled due to circumstances attributable to Geusseltbad—such as sudden illness of the instructor, technical issues, etc.—Geusseltbad will consult with the customer to arrange a suitable time to make up the missed lesson(s). As a rule, no refund will be issued.

Supervising adults of swimming lesson participants are permitted to assist with changing clothes, which requires passing through the access gates. Immediately after the swimming lesson participant has been handed over to the instructor, the supervising adult must leave the pool area. Swimming lessons may not be attended from within the pool itself. Supervising adults can observe the lessons from the spectator gallery on the first floor.

1. To participate in the swimming lesson, the customer must validate their swimming lesson pass at the turnstile.
2. The swimming lesson participant may use the changing and shower facilities of the Geusseltbad.
3. The participant may pass through the turnstile up to fifteen minutes prior to the start of the lesson in order to change. They may be assisted by a supervising adult, who must leave the pool area immediately after the participant has been handed over to the instructor. During the final five minutes of the lesson, the supervising adult may enter the pool area to collect the participant. After assisting with changing, both the participant and the supervising adult must exit the facility via the turnstile.
4. After the swimming lesson, the participant must leave the pool. The participant is not permitted to use the other pools.
5. The pool area may only be entered with the instructor’s permission. Until that time, one must wait at the sliding door between the shower area and the pool area.

Swimming lesson participants are required to comply with the house rules that apply when visiting Geusseltbad.

Once the diploma has been obtained, the swimming lesson pass will be deactivated and can no longer be used to access Geusseltbad. However, the pass may be reloaded for a different product, such as recreational swimming, if desired.

If a swimming lesson participant wishes to progress to the next diploma level after obtaining their current diploma, this must be communicated immediately after the pre-certificate swimming session. The participant can then be scheduled into the new group without a waiting period.
